The case of Point Solutions Ltd Focus / Business Solutions Ltd and Others 2007 [], which was heard in the Court of Appeals involving the applicant, was used as a provider of software, especially software for creating and the use of electronic forms delivery of financial services.
At the time of the acts of the defendants, a number of years, was the dominant supplier in this market. In April 2001 the complainant was theDefendants have entered into an outsourcing agreement under which the applicant has worked to achieve the defendants, including the work of an overview of a software module on the objectives of the accused. To undertake this work, the applicant three software modules for the purposes of the defendants have received.
Through its activities, provided that the applicant is a software product called Acuo, a product during a period from 2 July 2001 and August 2002 was developed DevelopingSoftware Acuo was in response to an approach to CMI, a well known provider of retirement.
In October of 2001 ended the subcontracting agreement between the claimant and the defendant. Obviously, defendant learned that the complainant had received a contract to CMI, so that the accused has made a failed attempt, and that the applicant intends to return (to H offer various contracts with the parent company of CMI), in direct competition with the defendants.
Defendantsdemanded the return of the three modules of the objectives of the software. He said to meet this demand. In October 2002 the defendant wrote to the applicant:
"Prompt software they developed to compete with [the accused]"
The defendants also have to confirm that the applicant is not a copy of the software of the objectives of the accused or solutions. The author responded, confirmed that he had copiedSoftware of the defendant, and offered to make a voluntary declaration (the third confirmed for a mutually acceptable) material that no infringement of copyright.
The parties have agreed on the identity of the experts who will be responsible, and the mandate on the basis that you will be required and it should act. However, the case is not advanced. Finally, in December 2004 the applicant brought an action for declaration of non-infringement of copyright. Itcharged that the reports can be obtained, but the parties fail to comply with this direction. The court refused to grant the assistance requested, and said he had been invited, a statement that the software had not yet seen, not to make against the copyright of another software product that has not yet seen. It was then that the evidence is not yet the author in relation to such software.
The plaintiff appealed. IntroducedAppeal:
– The fact that the court erroneously that the plaintiff was not based on a balance of probabilities, to copy the source code of the defendant in the production of software Acuo;
– The fact that the judge had ruled that non-profit to make a statement, but have not been copied;
– The conclusion that it exercised its discretion to grant a declaration, although in his favor on the issue of foundFailure is not a pervert.
The appeal is dismissed.
The applicant has not demonstrated that the judge had wrongly concluded that a balance of probabilities that have not copied the source code of the defendants in creating Acuo Software. Therefore, it has caused two other reasons.
It is interesting to note that the court should be so slow that it is the work of this kind brought to justice in cases where the parties have chosen,(Ignore for tactical reasons and medico-legal), which is already the instructions for the provision of support given by experts, if necessary, should the judge decide the real issue.
